Reporting Copyright Infringement
In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), I respond to notices of alleged copyright infringement on QTBird.com that comply with the law and are sent to my designated Copyright Agent:
Copyright Agent: Sara Noel
Mailing address: [MAILING ADDRESS]
Phone: [PHONE NUMBER]
Email: [EMAIL ADDRESS]
Your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you believe was infringed or, if several works are involved, a representative list of them.
- The URL or other location of the material you believe is infringing, or enough information for me to find it.
- Your name, mailing address, phone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
A notice that does not meet all of the requirements of Section 512(c)(3) of the DMCA may not be effective.
Please be aware that if you knowingly and materially misrepresent that material is infringing, you may be held liable for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA. You may want to consult an attorney before sending a notice. More information about the DMCA is available from the U.S. Copyright Office.
Filing a Counter-Notice
If you believe content you posted was removed by mistake or misidentification, you may send a counter-notice to the Copyright Agent above that includes:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and where it appeared before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located (or, if you live outside the U.S., any judicial district in which QTBird.com may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When I receive a valid counter-notice, I will forward it to the person who filed the original notice. If they do not notify me within 10 to 14 business days that they have filed a court action to stop the use of the material, I may restore it.
Repeat Infringers
In appropriate circumstances, and at my discretion, I will close the accounts of users who repeatedly infringe, or are repeatedly charged with infringing, the copyrights or other intellectual property rights of others.
Disclosures
I may share any communications about copyright notices or other rights complaints with third parties, including the affected users, the rights holders, and third-party databases that collect copyright notices.
